TRANSFER SERVICE AGREEMENT

1 – Parties

AYS REHBERLİK TURİZM ORGANİZASYON shall hereinafter be referred to as “AYS Transfer.”

The person whose name and surname are specified in the reservation and/or the persons represented by them shall hereinafter be referred to as the “Consumer” or “Customer.”

2 – Subject

This Agreement is concluded between the Consumer and AYS Transfer. It regulates the rights and obligations of the parties regarding the sale of services whose qualifications and sales conditions are specified on the AYS Transfer website and which are sold via telephone or electronic media.

Under this Agreement, the parties agree that AYS Transfer shall provide transfer services from addresses or hotels designated by the Customer to the airport and/or vice versa before or after flights, in return for payment, in accordance with the terms set forth below.

3 – Service and Payment Information

• The contract price is the amount stated in the reservation confirmation form.

• For private transfers, requests for additional stops outside the specified route:

• If on the route and without waiting time → included in the price.

• If off the route → an additional fee determined by AYS Transfer shall be paid by the passenger on site.

• AYS Transfer reserves the right to change the transfer vehicle when necessary without prior notice and without additional charge. If the Customer does not accept the change, they may cancel the reservation and receive a full refund. No compensation rights shall arise in this case.

• The Consumer authorizes AYS Transfer to charge the service fee via the credit card details entered into the system. The system is protected with 3D Security encryption. The Consumer is responsible for the entered credit card information.

• According to Turkish Tax Procedure Law (V.U.K.), the invoice shall be issued within 7 days from the purchase date, provided that it does not exceed the same month.

The vehicle type selected by the Customer:

• VIP vehicle (Vito / Caravelle)

• Minibus (Crafter / Sprinter)

• Midibus

• Bus

5 – Payment Methods

• Cash (payment to the driver)

• Bank transfer (to company accounts)

• Credit card (online payment via website)

6 – Number of Passengers

The Consumer is obliged to declare the number of passengers.

7 – General Provisions

Passengers are required to wear seat belts in compliance with traffic laws and safety regulations.

Even if the Consumer has not physically signed this Agreement due to payment via bank or credit card, the Consumer shall be deemed to have learned and accepted the terms of this Agreement as published on the website or advertisements.

Reservations must be made at least 6 hours before the service time. During religious and national holidays, New Year’s Day, and official holidays, reservations must be made at least 48 hours in advance. Cancellations made at least 6 hours before the service time shall be refunded. Later cancellations are non-refundable.

The route between departure and destination shall be determined exclusively by AYS Transfer, considering traffic and road conditions. Except for allocated vehicle and tour services, the Customer may not change the route. AYS Transfer is only obliged to transport the Customer from one designated point to another designated point or between a designated point and the airport.

AYS Transfer guarantees that all vehicles are fully insured, regularly maintained, and equipped with mandatory safety equipment (spare tire, first aid kit, fire extinguisher, reflector, etc.).

In the event of traffic accidents or other incidents causing bodily or material damage to the Customer or their belongings, AYS Transfer shall not be held liable beyond the limitations imposed by applicable law.

The Customer must inform AYS Transfer of any flight changes or delays by phone or email (info@aystour.com). In delays exceeding 3 hours, AYS Transfer reserves the right to modify service conditions without prior notice.

Each passenger is entitled to 20 kg of luggage. The Customer declares that luggage does not contain flammable, explosive, illegal, radioactive, or prohibited materials under Turkish law. If such materials are detected, the luggage will not be accepted and authorities may be notified.

Pet transfers must be declared during booking. Pets must be transported in proper cages, under the Customer’s responsibility, and in compliance with Turkish law.

AYS Transfer shall wait 15 minutes at the designated pickup location. After 15 minutes, the driver is not obliged to wait further.

Children under 12 may not travel without an adult companion.

In cases of force majeure (weather conditions, road conditions, mechanical breakdown, sudden health issues, police checks, etc.), AYS Transfer shall only be obliged to refund the prepaid service fee. No further compensation shall be payable.

8 – Force Majeure

Events beyond the control of the parties such as natural disasters, adverse weather, social unrest, strikes, war, emergency declarations, or other force majeure events shall suspend the Agreement until such conditions cease. Such circumstances shall not entitle either party to termination or compensation.

9 – Cancellation Conditions and Other Provisions

Promotional services are non-refundable and non-changeable. Requests for cancellation or refund after the service date has passed are invalid.

10 – Jurisdiction

Turkish law shall apply to any disputes arising from this Agreement. Antalya Courts and Enforcement Offices shall have exclusive jurisdiction.

11 – Effectiveness

Passengers benefiting from the service shall be deemed to have accepted the terms of this Agreement. This Agreement is executed in two copies and signed by the parties. Law No. 4925 on Road Transport and other relevant Turkish legislation shall apply.

I have read, understood, and accepted all terms of this Agreement, including the departure date and time and Law No. 4925 on Road Transport, and received a copy thereof.
